1. Introduction

DzjinTonik N.V. respects your right to the protection of your Personal Data and ensures optimal security of your information.

As the provider of the software application ‘DzjinTonik’ which you use to register as a candidate for participation in a television program [to be supplemented if necessary], DzjinTonik acts as a Processor of Personal Data on behalf of the production company or television channel that manages this program. This processing is carried out in accordance with the privacy policy of the respective production company or television channel.

Additionally, DzjinTonik also acts as the Controller of your Personal Data. In such cases, the processing is conducted based on this Privacy Policy.

2. Applicability of the Privacy Policy

This Privacy Policy applies to all individuals whose data is processed through the software application of DzjinTonik (hereinafter referred to as ‘the Software’) and who have explicitly consented during their registration to the processing of their Personal Data by DzjinTonik for the purposes specified in Article 6.

Additionally, this Privacy Policy applies to all individuals who provide their contact details to DzjinTonik in the context of other interactions.

DzjinTonik may amend this Policy from time to time.

The use of the information that DzjinTonik collects and processes is subject to the Privacy Policy in effect at the time the information is collected and processed. If DzjinTonik makes any material changes to the manner in which it collects or processes Personal Data, it will announce such changes in a timely manner.

Users are bound by any modifications to the Privacy Policy as soon as they use the Software after such modifications have been announced, unless the changes are so fundamental that DzjinTonik deems it necessary to obtain your explicit prior consent.

3. Definitions

The following definitions apply:

  1. “DzjinTonik”: DzjinTonik N.V., with its registered office at 2920 Kalmthout, Kapellensteenweg 488, and email address info@DzjinTonik.eu.

  2. “Personal Data”: any information relating to an identified or identifiable natural person (“the data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more elements specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

  3. “Software”: the software application "DzjinTonik" designed for workflow management of productions within the audiovisual sector.

  4. “Processing”: any operation or set of operations performed on Personal Data or sets of Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, updating or modification, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction of data.

  5. “Purposes”: the purposes of Processing as defined in Article 6.

  6. “Services”: the software-based collection and processing of Personal Data for companies and organizations in the audiovisual sector, aimed at automating the workflow of audiovisual productions, including the administrative handling of resource planning & drama planning, scriptwriting & scheduling, budgeting & finance, audition and casting planning, questionnaires, and integrations.

  7. “Clients”: companies that use the Services of DzjinTonik to better organize their own services.

  8. “Users”: individuals who use the Software by creating a personal Profile.

  9. “Controller”: the natural or legal person, public authority, agency, or other body that, alone or jointly with others, determines the purposes and means of the Processing of Personal Data.

  10. “Processor”: the natural or legal person, public authority, agency, or other body that processes Personal Data on behalf of the Controller

4. Personal Data collected and processed by DzjinTonik

  1. Personal Data provided by you to DzjinTonik

    The Personal Data that you provide to DzjinTonik includes:

    1. Your first and last name;
    2. Your address, including street and house number, postal code, city, and country;
    3. Your email address;
    4. Your (mobile) phone number;
    5. Your date of birth;
    6. Your profile picture;

    You guarantee that the data you provide (if applicable, via the Software) is accurate and correct.

  2. Automatic processing of Personal Data

    When you use the Software, DzjinTonik will automatically collect and process certain data related to your browser or mobile device, including:

    1. Your IP address;

    2. Your browser type;

    3. Your mobile network provider;

    4. The following information related to your mobile device or browser:

      • UUID;
      • Manufacturer;
      • Model;
      • Platform;
      • OS version;
      • OS language;
      • OS user language;
      • Battery level;
      • Charging status (Yes/No).
    5. Application IDs;

    6. Cookie information;

    7. Information related to your use of the Software, including the pages you visit.

5. Lawfulness of the processing of Personal Data

The processing of your Personal Data by DzjinTonik is carried out:

  1. Based on your explicit, free, and informed consent granted to DzjinTonik for this purpose; and
  2. To safeguard the legitimate interests of DzjinTonik, specifically for the expansion of its activities.

6. Purposes of the processing of Personal Data

  1. DzjinTonik collects and processes your Personal Data solely for the following purposes:

    1. To enable your registration and authentication when using the Software;
    2. To allow you to use the Software;
    3. To enable DzjinTonik to analyze, personalize, and optimize the content, functionality, and security of the Software for all users;
    4. To provide customer support to users via email (including responding to inquiries and providing requested information);
    5. To maintain statistical records for the purpose of making these statistics available (whether or not for a fee) to third parties, such as, but not limited to, production companies, television channel operators, etc.;
    6. To conduct direct marketing;
    7. To provide and fulfill any additional services ordered by the Client and/or offered to the Client or Users, including but not limited to installation services, second-line support, training, etc.;

DzjinTonik will not process your Personal Data in a manner that is incompatible with the stated Purposes.

Any use of your Personal Data for purposes other than those specified will always be presented to you in advance for approval.

  1. DzjinTonik emphasizes that you have the right to object to the disclosure or use of your Personal Data for direct marketing purposes or targeted advertising based on your browsing behavior.

    DzjinTonik will deactivate the use of your Personal Data for direct marketing and targeted advertising based on your browsing behavior upon receipt of your request via email at info@DzjinTonik.eu, with the subject line: "Objection to the use of Personal Data for marketing purposes."

7. Processing of Personal Data by Subcontractor(s)

DzjinTonik may engage subcontractors for the processing of Personal Data for the Purposes outlined in Article 6.

DzjinTonik will only engage subcontractors who receive Personal Data from DzjinTonik for the purpose of processing it on behalf of DzjinTonik, under the following conditions: (i) In accordance with DzjinTonik’s instructions; and (ii) In line with DzjinTonik’s commitments to Users as set out in this Privacy Policy.

Currently, DzjinTonik relies on the following subcontractor(s):

  • SEAFOX Ltd., a company incorporated under Bulgarian law, with its registered office at Bulgaria, Varna, 113 General Kolev Blvd., Office 3.2, UIC Code №: 2012246127.

8. Sharing of Personal Data

We do not transfer your Personal Data to anyone outside DzjinTonik without your consent. However, you expressly agree that we may share your Personal Data with:

  • Our independent contractors and employees, who perform specific processing activities under our instructions and strict supervision;
  • Government authorities or third parties, to the extent that we are legally required to do so under applicable laws or a court order.

DzjinTonik shares Personal Data with subcontractors and/or third parties only to the extent necessary for the Purposes defined in Article 6.

9. Storage of Personal Data

DzjinTonik retains Personal Data in a format that allows for your identification, for the period necessary to achieve the Purposes defined in Article 6.

10. Access to Personal Data, partability, rectification of deletion of Personal Data

  1. Access and Rectification of Personal Data

You may access, modify, or rectify your Personal Data by sending an email to info@DzjinTonik.eu, with a copy of your identity card attached.

You may also obtain your Personal Data in a structured, commonly used, and machine-readable format if you wish to transfer it to another Controller.

The list of Personal Data may change as the Services evolve.

Even after modification or rectification of Personal Data, copies of such data may remain visible elsewhere, to the extent that the Personal Data has been shared with others, distributed according to your privacy settings, or copied by other Users.

  1. Right to deletion of your Personal Data

DzjinTonik will delete your Personal Data from the Software upon receipt of your request via email at info@DzjinTonik.eu, with the subject line: "Deletion of Personal Data", accompanied by a copy of your identity card. You must specify which Personal Data you wish to have deleted.

Even after the deletion of Personal Data, copies may remain visible elsewhere to the extent that the Personal Data was shared with others, distributed according to your privacy settings, or copied by other Users. DzjinTonik will take reasonable measures to inform third parties to whom your Personal Data was transferred of your request, in order to delete any reproductions of your Personal Data.

Deleted Personal Data will not remain in DzjinTonik’s backup system for more than ninety (90) days.

10. Restriction of processing

You have the right to request DzjinTonik to restrict the processing of your Personal Data if:

  • You contest the accuracy of the Personal Data;
  • The Processing is unlawful, and you prefer a restriction of processing rather than the deletion of the data;
  • DzjinTonik no longer needs your Personal Data for the Purposes outlined in Article 6, but you require them for the establishment, exercise, or defense of a legal claim;
  • You have objected to the processing. If you wish to request the restriction of the processing of your Personal Data, you must send an email to info@DzjinTonik.eu, accompanied by a copy of your identity card.

11. Right to object

You have the right to object to the processing of your Personal Data if you provide compelling and legitimate reasons related to your specific situation.

"Compelling" means that you must demonstrate reasons indicating that the processing may have adverse consequences for you. "Legitimate" refers to data indicating that the processing is conducted without a legal basis or unlawfully.

If you wish to object to the processing of your Personal Data, you may send an email to info@DzjinTonik.eu, accompanied by a copy of your identity card.

12.Deletion of your profile

The responsable party of the Processor will delete your Profile upon receipt of your request, which must be sent to the Controller of the Processor with the subject line: "Deletion of Profile", accompanied by a copy of your identity card.

Upon deletion of your Profile, your Personal Data will be removed from the Software and DzjinTonik’s servers. This deletion will be processed as quickly as possible, and no remaining copies of your Profile will be retained in backup files for more than ninety (90) days.

13. Safety and confidentiality of your Personal Data

DzjinTonik will take all technical and organizational measures to ensure the security and confidentiality of your Personal Data, in order to prevent the accidental, unauthorized, or unlawful (i) destruction, modification, alteration, or loss of Personal Data; (ii) the disclosure of or access to Personal Data by unauthorized parties; and (iii) any unauthorized or unlawful forms of Processing.

The security measures will comply with applicable data protection laws and will be tailored to the risks associated with the Processing and the nature of the Personal Data being processed, taking into account the state of the art and implementation costs. DzjinTonik will immediately notify you of any security or confidentiality breach unless a legal prohibition prevents such notification.

DzjinTonik will implement all necessary measures to ensure that its employees comply with obligations regarding your Personal Data. Employees who require access to this data will be required to sign an individual confidentiality agreement.

The Software and website of DzjinTonik may contain links to other websites. DzjinTonik is not liable or responsible for the privacy policies or practices of other websites. You are therefore advised to review the privacy policy of the respective website.

The Personal Data linked to your Profile is protected for your privacy and security by means of a password. You should prevent unauthorized access to your Profile and Personal Data by carefully selecting a strong password and keeping it secure, limiting access to your computer and browser and logging out after each use of your Profile.

14. Transfer of Personal Data to third countries

For the effective functioning of the Services, DzjinTonik may, if necessary, transfer Personal Data to countries outside the European Union. These countries may not provide a level of data protection equivalent to that of the European Union. If DzjinTonik transfers your information to countries outside the European Union, it will implement necessary measures to ensure that your privacy rights remain protected to the same extent as provided in this Privacy Policy.

If you use the Software while outside the European Union, your Personal Data may be transferred to countries outside the EU.

By providing your Personal Data to DzjinTonik, you expressly consent to the transfer of your Personal Data outside the European Union in the manner described above.

15. Notification of a data breach

If a breach related to your Personal Data occurs that poses a high risk to your rights and freedoms, DzjinTonik will explicitly notify you.

Specifically, DzjinTonik will inform you of:

  • The nature of the breach;
  • The data reported to the relevant Supervisory Authority;
  • The measures taken.

16. Data protection officer

To ensure the protection of your Personal Data, DzjinTonik has appointed a Data Protection Officer (DPO). This officer is available to provide you with information regarding the processing of your Personal Data.

18. Complaints

If you are not satisfied with the manner in which your Personal Data is being processed, you have the right to file a complaint with the Belgian Data Protection Authority. You can contact them via contact@apd-gba.be or by mail at the following address:
